Are the one, an instrument in law making and law enforcing above law and its hands in India?

The APEX Court of India#(Honorable Supreme Court) sits to interpret the Fundamental Rights (Equality before law) of Indian Citizens. Now the Ministry of Home Affairs has overtaken the jurisdiction of this court. Now it will decide who has committed the crime and who has not committed it. The sanction to prosecute former Special Director of Intelligence Bureau Rajendra Kumar, and his three colleagues, ,P.Mittal,M.K.Sinha and Rajiva Wankhade in the killing of Ishrat Jahan case is denied to CBI. Rajendra Kumar can neither be charge sheeted nor tried to bring to final justice as ministry finds them innocent.
#CBI agency cannot lay its hands on them. In case of an ordinary citizen, there is no need to take approval in their cases as they are without any custodian neither government nor judiciary .Is this an equality before law?
