TRIPLE TALAQUE WRANGLING IN INDIA.

DISSOLUTION OF MUSLIM COUPLE`S MARRIAGE WITH PRONOUNCEMENT OF WORD TALAQUE THRICE IN  ,A RECENT WRANGLING AMONG NON PLAYERS AND SEMI LITERATE MEDIA MEN AND SUB LITERATE MUSLIM EXPERTISE .

Now a segment of enlightened as well as close minds in India seem to be very desperate to find answer to very much talked and practiced three talque pronouncements in separation between the two individuals .All including liberal women sisters among the community are seen very agitated now. It has  prompted  them to question the practice and a feeling of treating them inferior to male ones more so in light of the constitution of Republic of India (Equality before law) irrespective of cast creed and gender. The failure to defend their view points by Muslim advocates (scholars)and as also the arguments advanced by the  party (antagonists)appear to be  a wishful exercise. Amidst this ambivalent the supreme court is also concerned and confused .

It is never the will of God (Creator)either His doctrine enshrined in the Book ,their  universal constitution which governs their life with  complete accountability (answerable to Him) to dissolve the marriage in three stroke of words. In most of the cases , happy conjugal life terminates with the extinction of life of either partners.In some cases, of late statistic towards higher side, is aborted by the three straight pronouncements by husband earlier in presence of the responsible witnesses of the two sides. The permission of this arrangement by Him by three pronouncement itself suggest three steps all with considerable gaps leaving the husband to review his decision and reach understanding .This is not disputed .

There are moments when husband is responsible for building up tension. His family members are also held responsible for scuttling the relations between the two on issues which could be otherwise resolved. At times the wife is also guilty for the introduction /initiations of those hate words. So are their parents.

There comes moments of point of no return in their life. The two are at a dagger drawn which is in existence for months and years. Reconciliation is almost   exhausted. The best solution in this case is the application of those unkind words.

Suppose the courts come to a solution that wife should also be given the right to dissolve the  bond reached  in the same fashion .All right .Is there statistics available anywhere in the society in this case with advocates (Crocodile tears only )to prove its judicious frequency?  They must know the  right is there to seek dissolution of her marriage on better social  and moral grounds  faster disposal than the present family Courts working under the nose of governments .I find it futile for the third party (PIL ) to fight for them .Those involved must seek help of the court.

Neither our Moulvees ,only hungry for TV popularity (an Un Islamic conduct)are well read,  ,nor those shedding crocodile tears have exceptional but rarest  suggestion in their minds. Those Interested may see and update themselves with Surat-ul-Albaqra verse 225 to 242 and may see  the commentary  of these verses from an author Hazrat Moulana Mufti Mohammad Shafi Saheb (RA) in  his book Maareful Quoran volume one pages 498 -530 preferably page 503(triple talaq) .NB:English translation of the above mentioned verses can be seen next on 16 th of April.
